{"id":216080,"date":"2022-06-06T12:55:00","date_gmt":"2022-06-06T12:55:00","guid":{"rendered":"https:\/\/womeninadria.com\/ugovor-o-radu\/"},"modified":"2026-06-24T17:38:14","modified_gmt":"2026-06-24T15:38:14","slug":"ugovor-o-radu","status":"publish","type":"post","link":"https:\/\/womeninadria.com\/bs\/ugovor-o-radu\/","title":{"rendered":"\u0160to trebate znati o Ugovoru o radu?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Dina Durakovi\u0107 je advokatica i suvlasnica advokatskog ureda&nbsp;<a href=\"https:\/\/www.linkedin.com\/in\/dina-durakovi%C4%87-dmb\/\">DMB Legal<\/a>&nbsp;i osniva\u010dica Impact fondacije, specijalizirana za korporativno i radno pravo, te internacionalne akvizicije<\/strong>.&nbsp;<\/p>\n\n\n\n<p class=\"has-drop-cap wp-block-paragraph\">Ugovor o radu je najbitniji dokument koji zaklju\u010dujue poslodavac i radnik\/ica, te je potrebno pristupiti ozbiljno njegovoj izradi i osigurati da sadr\u017ei sve bitne elemente propisane Zakonom o radu i da su oni na adekvatan na\u010din formulisani. Treba znati da je u slu\u010daju bilo kakvog pravnog spora izme\u0111u radnika\/ice i poslodavca, Ugovor o radu u pravilu prvi dokument u kojem se tra\u017ee odgovori na sporna pitanja.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Glavni elementi Ugovora o radu<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">U FBiH nije propisana forma Ugovora o radu, ali Zakonom o radu su propisani njegovi bitni elementi, te je na taj na\u010din regulisan njegov sadr\u017eaj. U RS postoji propisana forma Ugovora o radu. U oba entiteta, Ugovorom o radu je potrebno regulisati osnovne elemente radno-pravnog odnosa, uklju\u010duju\u0107i njegovo trajanje, dan po\u010detka rada, mjesto rada, opis poslova, raspored radnog vremena, pla\u0107u i dodatke\/naknade, godi\u0161nji odmor, otkazni rok i sl.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Osnovna prava radnika\/ice prema postoje\u0107im radno-pravnim propisima u BiH odnose se na pravo na pla\u0107u, ograni\u010deno radno vrijeme (40 sati sedmi\u010dno), ograni\u010denje prekovremenog rada (u FBiH maksimalno dodatnih 8 sati, u RS dodatnih 10 sati sedmi\u010dno), minimalni godi\u0161nji odmor (najmanje 20 radnih dana), pravo na naknadu za vrijeme privremene sprije\u010denosti za rad (bolovanja, opravdanog odsustva). Zakoni propisuju&nbsp;minimum radni\u010dkih prava ispod kojeg se ne mo\u017ee i\u0107i, a poslodavac u svakom slu\u010daju mo\u017ee radniku\/ici dati ve\u0107a prava nego ona koja su Zakonom propisana. Bitno je napomenuti da kada poslodavac da odre\u0111eno pravo radniku\/ici izvan zakonskog minimuma (bilo u Ugovoru o radu ili nekom internom aktu, npr. Pravilniku o radu), mora i omogu\u0107iti radniku\/ici kori\u0161tenje tih datih prava.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Vrijeme trajanja Ugovora o radu i poslovna tajna<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Ugovor o radu se mo\u017ee zaklju\u010diti na odre\u0111eno i neodre\u0111eno vrijeme. Na odre\u0111eno vrijeme se Ugovor o radu (ili vi\u0161e uzastopnih ugovora) mo\u017ee zaklju\u010diti na period do 3 godine u FBiH, odnosno do 2 godine u RS (u RS je mogu\u0107e zaklju\u010diti na du\u017ei period u Zakonom propisanim slu\u010dajevima, npr. do zavr\u0161etka trajanja odre\u0111enog projekta ali ne du\u017ee od 5 godina). U ovom smislu, postoji jo\u0161 jedna razlika izme\u0111u propisa u FBiH i RS, a to je da je u RS-u Ugovor o radu na neodre\u0111eno vrijeme pravilo, a samo u slu\u010daju postojanja objektivnih razloga (rok, izvr\u0161enje ta\u010dno odre\u0111enog posla ili nastupanje nekog unaprijed odre\u0111enog doga\u0111aja) poslodavac i radnik\/ica mogu zaklju\u010diti Ugovor na odre\u0111eno vrijeme. U FBiH nemamo ovakvog ograni\u010denja, pa je mogu\u0107e zaklju\u010diti Ugovor o radu na odre\u0111eno vrijeme u svakom slu\u010daju.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u010cesto je novim Ugovorima o radu prisutno i ugovaranje odredbi o za\u0161titi poslovne tajne kojima se obavezuje radnik\/ica da \u010duva poslovne tajne poslodavca za vrijeme i nakon prestanka radnog odnosa.
